Twelve transient occupants
A dwelling let for thirty days or less stays under the residential code only while it is three storeys or fewer, under 5,000 gross sq ft and sleeps twelve or fewer. At thirteen it is an R-3 occupancy under the commercial building code and loses the fire sprinkler exemption. The county prices its own rental permit on exactly that line: $250 a year up to twelve, $250 plus $25 per occupant from thirteen.

Short-term rental unit permit
Since 1 January 2024 every short-term rental outside city limits has needed an annual permit and a yearly fire inspection. The county reports over 6,500 units operating and has hired eight full-time fire inspectors, working the county in districts. There are separate application routes for a new build and for turning an existing residence into a rental.

Critical Slope Overlay
On land steeper than 30 per cent the side and rear setback rises to 100 ft and the separation between buildings to 200 ft. A sprinkler system halves both, to 50 ft and 100 ft. Minimum lot size is 2 acres between 30 and 50 per cent slope and 3 acres above it, height is capped at 35 ft, and post-construction impervious area cannot exceed 15 per cent of the lot.

Septic is run by the county
Sevier County Environmental Health issues the septic permit, not a state office. A new permit is $300, a repair $75, and a failed final costs $100 to re-inspect. The department's posted processing time for a new application is three weeks, it wants a high-intensity soil map and a plat sealed by a registered surveyor, and the permit expires three years from issue and cannot be renewed.

Confirmed with the building official. Sevier County adopts its codes by commission resolution and publishes no filled-in Table R301.2, so the ultimate design wind speed, ground snow load, seismic design category and frost depth get settled with Building Inspections before drawings are finalised. In a county running from the river bottoms to 6,643 ft at Kuwohi, one blanket figure would be the wrong tool anyway.

Firewise zone around a rental
Inside the Critical Slope Overlay a five-foot noncombustible zone around the building envelope is required for short-term rental units and recommended for every dwelling. Mulch, flammable plants, leaves, needles and firewood piles are prohibited within it, and clearing debris and brush piles have to leave the parcel altogether.

Exterior colour in the Hillside Overlay
There is no county-wide restriction on metal siding or metal roofing anywhere in the zoning regulations. The one appearance rule is narrow: in the Hillside Overlay District, and only for a lot that cannot keep disturbance within 25 per cent of its area, exterior colours including roofing, siding and fascia must be muted dark earth tones with a light reflectance value below 40. A bright galvalume roof fails that test; a dark standing-seam one passes it.

Driveway grades
The first 20 ft in from the road cannot exceed 12 per cent and the rest of a private drive 18 per cent, rising to 25 per cent inside the Critical Slope Overlay. Anything steeper than 12 per cent has to be pavers, concrete, asphalt or brick rather than gravel, and the drive has to be at least 12 ft wide. On a mountain lot that is often the first real cost nobody budgeted for.

Building permit fee
A one- or two-family dwelling is $375 up to 1,500 sq ft enclosed, then 25 cents per square foot above that, crawl spaces excluded, on a schedule effective 1 May 2021. Inspections run footings, under-slab plumbing, rough framing, rough plumbing, energy including HVAC and gas pipe, and final. Building without a permit adds $200 for a first offence and $350 for a second, on top of the regular fee.

No minimum house size, and no rule aimed at this build type
The zoning regulations set no minimum heated floor area, no required garage or porch, no minimum roof pitch, no required overhang and no masonry percentage, and the word barndominium appears nowhere in them. What the resolution actually regulates is ground: slope, disturbance, impervious cover, driveway grade, frontage and lot size.

Overnight rentals have their own parking row
The zoning parking table gives a transient overnight rental one space per bedroom, minimum two, against two spaces plus one per two bedrooms over four for an ordinary dwelling. On a six-bedroom cabin that is six spaces rather than three, and on a steep lot every one of them counts against the 15 per cent impervious cap.

Those are the same conditions that decide whether a septic field passes its soil and site evaluation, so the grading plan, the footing depth and the drainfield get resolved together rather than one at a time. Do I need a building permit in unincorporated Sevier County?
Yes, and a local one. Sevier County received exempt jurisdiction status from the state on 28 November 2023, which means it adopts and enforces its own codes rather than leaving houses to the State Fire Marshal. The permit comes from Sevier County Building Inspections at 227 Cedar Street in Sevierville, and applications have been online since April 2023. Four things have to be in hand before the building permit will issue: the environmental health approval, zoning compliance, a floor plan and contractor information. Inspections run footings, under-slab plumbing, rough framing, rough plumbing, energy including HVAC and gas pipe, and final, and your property lines have to be marked for the footing inspection. On the published fee schedule a dwelling is $375 up to 1,500 sq ft enclosed and 25 cents a square foot above that, so a 2,400 sq ft building works out at $600. The county also accepts third-party plans examination and inspection if you would rather not queue. And on the structure itself, a clear-span rigid frame sits outside the prescriptive tables, so IRC R301.1.3 requires it to be designed by a Tennessee-licensed engineer whichever route you take.
I want to build it as a rental cabin. Does that change the code?
It changes one thing enormously, and the number is twelve. A dwelling occupied for thirty days or less is a transient rental home, and it stays under the residential code only while it is three storeys or fewer, under 5,000 gross sq ft and sleeps twelve or fewer occupants. Cross any one of those and the State Fire Marshal classifies it as an R-3 occupancy under the commercial building code, and it loses the fire sprinkler exemption that residential dwellings enjoy. Sevier County administers the same line: its short-term rental permit is $250 a year for twelve or fewer, and $250 plus $25 per occupant from thirteen up, and it publishes a notarised letter you use to drop back to twelve while a fire protection system is put right. So decide the sleeping capacity at sketch stage, not after the beds are ordered. Thirteen is not one more bed than twelve. It is a different code, a different permit route and a sprinkler system.
My lot is steep. What does the Critical Slope Overlay do to the plan?
Land steeper than 30 per cent, as mapped, brings a set of rules that reshape the building before the design starts. The side and rear setback goes to 100 ft and the separation between buildings to 200 ft, both halved to 50 ft and 100 ft if the building has a sprinkler system, which on a narrow mountain parcel is often the difference between buildable and not. Minimum lot size is 2 acres from 30 to 50 per cent slope and 3 acres above it, height is capped at 35 ft, and post-construction impervious area cannot exceed 15 per cent of the lot. Cut and fill slopes steeper than 2:1 have to be designed by a licensed engineer and cannot exceed 35 ft in height, utilities go underground, and the finished work has to be certified as-built by an engineer or surveyor within 60 days. One thing worth knowing: the map is rebuttable. You can commission an alternative slope analysis from the county GIS department, a professional engineer or a registered land surveyor, banding the parcel at 15, 20, 30 and 50 per cent, and if under half the lot exceeds 30 per cent the steep-slope regulations do not bite.
Can I clad it in metal, and does the county care what colour it is?
Metal is fine. There is no restriction on metal siding or metal roofing anywhere in the Sevier County zoning regulations, and no minimum roof pitch, required overhang, masonry percentage or minimum heated floor area either. There is exactly one colour rule, and it is narrow enough to be worth stating precisely. In the Hillside Overlay District, a lot that cannot keep its disturbance within 25 per cent of the lot area has to accept mitigation measures, and one of those is that exterior colours including roofing, siding and fascia must be muted dark earth tones with a light reflectance value below 40. That is not a county-wide rule, it does not apply outside the Hillside Overlay, and it does not apply to a lot that stays inside the disturbance limit. But if your parcel is in the overlay and you want the driveway, parking and septic field a mill-finish panel would look wrong. Check the overlay maps with Planning and Zoning on (865) 453-3882 before ordering colours.
Who handles the septic permit, and how long does it take?

That is a county office rather than a state one, which is not true everywhere in Tennessee, and it means the person who decides your drainfield is local. A new septic permit is $300, a repair $75, an inspection letter $100 and a re-inspection after a failed final $100. The department's own posted processing time for a new application is three weeks, longer if information is missing or more than one site visit is needed. You will need a high-intensity soil map of the disposal area and a plat sealed and signed by a registered surveyor, and in the Shagbark, Sky Harbor and English Mountain subdivisions a current survey is always required. Permits expire three years from issue and cannot be renewed, so do not pull one early. Two warnings for a mountain lot: the same slope that gives you a walkout basement is the slope that can fail a site evaluation, and shallow rock is a real risk here. Get the soil work done before you commit to a lot, not after.
It is an agricultural building with living space in it. Am I exempt?
No, and this is the most expensive misunderstanding in the category. Tennessee's statewide standards do not apply to nonresidential farm buildings, and the load-bearing word is nonresidential. The moment the building contains a dwelling unit it is a one- or two-family dwelling and the exemption is gone. Sevier County's own regulations make the same distinction in their own words: the zoning height cap exempts agricultural buildings, including barns and silos, but not including dwellings. A shop, a hay barn or an equipment shed you do not live in is one thing. A building with a kitchen, a bathroom and a bed in it is a house, and it needs the permit, the inspections and the engineering that a house needs. If part of your building is genuinely unconditioned workshop and part is living space, say so on the application and let the building official scope the permit properly. That conversation is much cheaper before the slab than after.
